Second man is arrested in Lone Star College shooting

HOUSTON -- A shooting at a community college in north Houston this week that left three people wounded was sparked by an argument between two men, according to court documents released this week.

One of the pair responsible for the shooting at Lone Star College-North Harris Campus was arrested Tuesday, the day of the shooting, and a second the next day, officials said.

One of three people injured in the shooting, Jody Neal, told investigators that a man later identified as Trey Foster shot him after the two argued, according to a probable cause affidavit field with the Harris County district clerk and reviewed by The Los Angeles Times.

Neal, 25, suffered bullet wounds to his abdomen and leg, according to Alan Bernstein, a spokesman for the Harris County Sheriff’s Office.

“He was the apparent target of this dispute,” Bernstein told The Times.

Bernstein declined to comment about whether the gun used in the shooting had been recovered Friday, saying the sheriff was expected to make a statement later in the day.

Foster, 22, who is charged with two felony counts of aggravated assault, was taken to jail in Houston on Friday, Bernstein said.

Carlton Berry has also been charged with two counts of aggravated assault in connection with the shooting, Bernstein said.

Berry, 22, was shot in the leg during the incident and investigators were still trying to determine what role he played in the shooting.

It’s not clear whether the shooting was gang-related; some students said the area is frequented by Bloods. Both Foster and Berry were wearing red shirts at the time of the shooting, and Foster was wearing an Atlanta Falcons cap, the affidavit notes.

“Our people have interviewed more than a hundred witnesses,” Bernstein said, including Foster and Berry, and, “there are still many of the details that need to be sorted out.”

Others injured in the shooting included a maintenance worker for the college, Bobby Cliburn, 55, who was shot in the leg. A woman whose name has not been released also received medical treatment after the shooting for a possible anxiety attack.

According to the affidavit, Berry--who initially denied involvement in the shooting--later told investigators that he and Foster, who goes by “Trey,” were on the Lone Star campus about noon when Neal bumped into Foster and the two started fighting. The trio separated, but half an hour later, Berry and Foster saw Neal again, began arguing near a doorway to the school’s Academic Building and Foster started shooting at Neal.

Officials said at least 10 shots were fired.

The affidavit does not say who shot Berry and Cliburn.

Berry remained under police supervision at a Houston hospital Friday.

Alison Baimbridge, Harris County assistant district attorney, confirmed to The Times they have no intention of charging Neal.

“He’s a victim; we’re not charging him with a crime. He was unarmed at the time of the shooting,” Baimbridge said.

Baimbridge didn’t comment about whether the shooting was gang-related, saying officers are still investigating.

She said Foster was being held on $100,000 bond, and that Berry was expected to be transferred to jail soon on $60,000 bond.

Foster is scheduled to appear in court Monday morning, Berry on Wednesday, she said.
