Beer bars in Southern California feud about common name

Imitation may be flattering, but not to Clay Harding, owner of a popular craft beer bar and restaurant in Alhambra called 38 Degrees Ale House & Grill.

Harding recently learned that a new pub had opened in Carlsbad with the 38 Degrees name -- and he’s not happy about it, reports the blog thefullpint.com. “I will be making some phone calls, and seeing what I can do to protect my property,” Harding told the blog.

“I have and will always support those who spread the word, educate, brew and sell real, live craft beers,” Harding said. “I would welcome them as a brother in arms if they opened with an original name and look that defines who they think they are.”

The owners of 38 Degrees Carlsbad said they have no plans to change their name, thefullpint.com reported.

“I have registered the name and won’t give that up,” said Mayur Pavagadhi, owner of the Carlsbad restaurant.

He said 38 Degrees is a good name because it’s the temperature that bar owners keep their keg refrigerators, not because there’s a popular restaurant with the same name in Los Angeles County.

“I did do a search, and I found 38 Degrees Ale House in Alhambra. We are 38 Degrees Carlsbad. If I was Clay, I would be happy to have the publicity. If this was reversed, I would not make a fuss,” Pavagadhi told the blog.
