ORANGE : Judge Lifts Order Restraining Writer
A restraining order obtained last month by the president of the Orange Unified School District Board of Trustees against an editor-writer of a local newspaper was lifted Thursday.
Municipal Court Commissioner Eleanor Palk vacated the order after a two-hour hearing in Santa Ana. Palk said that Robert Bennyhoff, 71, managing editor of Common Talk, a free monthly newspaper distributed in Orange and Villa Park, did not pose a danger to Trustee Barry Resnick.
“A certain amount of criticism comes with being on the school board and no harassment was demonstrated,” said Michael Camber, Bennyhoff’s lawyer.
Resnick, elected to the board in 1989, was one of two board members who was not the subject of a recent failed recall attempt by a group of local parents.
While Bennyhoff, in an editorial column in Common Talk, did not support the recall attempt, he has made statements critical of Resnick.
Palk granted a temporary restraining order on Nov. 19 after a dispute between the two men over statements in Bennyhoff’s column.
