Local News in Brief : Stalker Motion Ruling Due
The presiding judge of the Orange County Superior Court has been selected to hear a defense motion seeking to remove a Los Angeles judge from the trial of Night Stalker suspect Richard Ramirez, attorneys said.
Judge Phillip E. Cox was selected to hear the motion by California Chief Justice Malcolm Lucas, who also is chairman of the California State Judicial Council. Ramirez’s attorneys want Superior Court Judge Michael Tynan removed from the case on grounds that he is biased against them.
Deputy Dist. Atty. P. Philip Halpin said Cox should rule soon on the request made by defense attorneys Daniel Hernandez and Arturo Hernandez. Halpin said that even if Tynan is removed from the case and replaced with another judge, jury selection should begin next Monday at the latest.
