Shallenberger murder case to be retried

A Palm Springs man accused of strangling noted attorney and Laguna Beach resident Garvin Shallenberger in his Palm Desert mobile home on Sept. 30, 2006 will be retried on the murder charge after a jury deadlocked 8-4 in favor of conviction, a spokesman for the Riverside County District Attorney’s office said.

Michael Salvador Anunciation, 48, is accused of killing the 85-year-old and taking the victim’s laptop computer, office equipment, wallet, credit cards and other items from the home.

Anunciation was acquitted July 21 of first degree murder, but convicted of petty theft and robbery in the case. The jury deadlocked on a lesser charge of second degree murder. He remains in jail without bail. The defendant has two prior felony convictions, according to the complaint.

The retrial has been set for Sept. 3, said Riverside County Distict Attorney spokeswoman Ingrid Wyatt.

Judge James S. Hawkins has issued a gag order on all parties in the case, Wyatt said.

Shallenberger served as president of the State Bar of California Board of Governors from 1977 to ’78. In 1978, he received the Orange County Bar Assn.’s lifetime achievement award.
