Irvine firm wins tentative ruling in fraud lawsuit
Irvine-based CombiMatrix Corp. said Tuesday that it received a tentative Orange County Superior Court ruling in its favor in a lawsuit by a former employee who alleged the molecular diagnostics company had committed insurance fraud.
The court ruled that the company “had no fraudulent intent” when it pursued insurance benefits from National Union Fire Insurance Co., CombiMatrix said.
In a 2011 lawsuit, Michael Strathmann accused CombiMatrix, former Chief Executive Amit Kumar and CombiMatrix’s former partner Acacia Research of submitting fraudulent insurance claims to National Union Fire Insurance. In 2010, CombiMatrix received $25 million from the insurer to settle a lawsuit that claimed National Union had refused to defend and indemnify CombiMatrix under its director and officer insurance policy.
After the Superior Court dismissed Strathmann’s complaint in May 2011, he appealed, and a California appellate court reversed the dismissal in late 2012. Another trial in Superior Court began last June.
Each party can file objections to the latest court ruling within 15 days. The court then would have 60 days to consider the objections and hear additional arguments before issuing a final ruling.
CombiMatrix specializes in DNA-based testing for prenatal and postnatal developmental disorders.
